Terms of Use

These Terms of Use (the “Terms”) are a binding agreement between you and ARCHSUN LLC (“ARCHSUN LLC”, “we”, “us”, “our”), a limited liability company organized under the laws of the State of Wyoming, United States. They govern your access to and use of this website and the Archonia game service (together, the “Service”).

Last updated: 17 September 2026.

Please read section 13 carefully. It requires most disputes to be resolved by individual binding arbitration and waives your right to a jury trial and to participate in a class action, unless you opt out within 30 days as described there.

1. Acceptance and eligibility

By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Cancellation & Refund Policy, each incorporated here by reference. If you do not agree, do not use the Service.

You must be at least 13 years old to hold an account. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for all activity and charges on the account. We do not knowingly permit anyone under 13 to register; see section 9 of the Privacy Policy.

2. Your account

  • You are responsible for keeping your credentials confidential and for all activity that occurs under your account.
  • Accounts are personal to you. Selling, renting, sharing, gifting or transferring an account is prohibited.
  • Provide accurate registration information and keep your email address current — account recovery depends on it.
  • Notify us promptly at [email protected] if you believe your account has been compromised.

3. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to access and play the game for your own non-commercial entertainment. All rights not expressly granted are reserved.

Except as applicable law permits without our consent, you may not:

  • copy, reproduce, republish, distribute, rent, sell, sub-license or create derivative works from any part of the Service;
  • reverse engineer, decompile or disassemble the client or server software;
  • use bots, macros, automation, third-party clients, memory editors, packet manipulation or any other tool that gives an advantage not available through ordinary play;
  • exploit bugs, duplication errors or unintended behaviour instead of reporting them;
  • scrape, crawl or harvest data from the Service except as permitted by our robots.txt;
  • interfere with the operation of the Service, or attempt to gain unauthorized access to any account, server or network.

4. Virtual items and virtual currency

This section describes what you are buying, and what you are not. It applies to “Cash Coins” (“CC”), the Chantra Pass, and every other virtual item, character, currency, cosmetic or in-game service (together, “Virtual Items”).

  • You are buying a license, not property. When you obtain Virtual Items you receive a limited, revocable license to use them within the game. You acquire no ownership interest in them.
  • Virtual Items have no monetary value. They are not currency, credit, a deposit, a security, a commodity, or property. They cannot be redeemed for cash or anything of real-world value from us, and we do not guarantee any value or continued availability.
  • They are not transferable outside the game. Selling, buying or exchanging Virtual Items or accounts for real money outside the Service is prohibited and may result in forfeiture of the items and termination of the account.
  • We may change them. We may add, modify, rebalance, re-price, suspend or remove Virtual Items at any time as part of operating and balancing the game. Game balance changes are not a defect and do not entitle you to a refund.
  • Your license ends when your access ends. If your account is terminated, or the Service is discontinued, your license to any unused Virtual Items ends with it and, except where the law requires otherwise, no refund is owed.

5. Purchases and payment

  • Prices and the total charged are shown before you confirm an order. You authorize us and our payment processors to charge the payment method you provide.
  • Payments are handled by third-party payment service providers. We do not receive or store your full card number. Their own terms and privacy policies apply to the payment step.
  • You are responsible for any taxes applicable to your purchase that are not shown at checkout, and for any fees or exchange-rate differences applied by your bank or card issuer.
  • You represent that you are authorized to use the payment method you submit.
  • Refunds and cancellations are governed by our Cancellation & Refund Policy.

6. Conduct and community rules

You agree not to use the Service to harass, threaten, defame, impersonate or discriminate against anyone; to post unlawful, obscene or infringing material; to advertise or solicit; to phish or defraud other players; or to encourage any of the above. We may set out further in-game rules, and those form part of these Terms.

7. Content you submit

The Service lets you submit content — chat messages, forum and comment posts, support tickets, character and guild names. You keep whatever rights you already hold in it. You grant us a worldwide, non-exclusive, royalty-free, transferable and sub-licensable license to host, store, reproduce, adapt, display and distribute that content for the purpose of operating, promoting and improving the Service.

You represent that you have the rights necessary to grant that license and that your content does not infringe anyone's rights or violate any law. We do not pre-screen submitted content and it does not represent our views. We may remove content and suspend accounts at our discretion.

8. Suspension and termination

We may suspend or terminate your account, or any part of the Service, if you breach these Terms or in-game rules, if we suspect fraud, chargeback abuse or unauthorized access, or if we are required to do so by law. Where practical and lawful we will tell you why. You may close your account at any time by contacting support; closing an account does not entitle you to a refund of Virtual Items already delivered.

9. Intellectual property

The Service, and all software, artwork, audio, text, characters, names, logos and other material in it, are owned by us or our licensors and are protected by copyright, trademark and other laws. You may not use our marks without prior written permission.

10. Copyright complaints (DMCA)

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512. If you believe material on the Service infringes your copyright, send a written notice to [email protected] containing: your physical or electronic signature; identification of the work claimed to be infringed; identification of the material you say is infringing and where it is located; your contact details; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law; and a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

We will remove or disable material in response to a valid notice and will terminate, in appropriate circumstances, the accounts of repeat infringers. If your material was removed, you may send a counter-notice meeting the requirements of § 512(g)(3) to the same address.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of loss of data or progress, or that any defect will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR OFFICERS, MEMBERS, EMPLOYEES OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, GOODWILL, DATA, GAME PROGRESS OR VIRTUAL ITEMS, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD 100).

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you.

13. Dispute resolution, arbitration and class-action waiver

Informal resolution first. Before starting any proceeding, please email [email protected] describing the dispute and the relief you seek. Most issues are resolved this way. Both sides agree to try in good faith for 60 days.

Binding individual arbitration. If the dispute is not resolved, you and we agree that any dispute arising out of or relating to these Terms or the Service will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. Judgment on the award may be entered in any court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights.

Class-action waiver. Disputes will be arbitrated only on an individual basis. YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE ACTION. If this waiver is held unenforceable as to a particular claim, that claim will proceed in court and the rest of this section still applies.

Your right to opt out. You may opt out of this arbitration agreement by emailing [email protected] with your account name and the words “ARBITRATION OPT-OUT” within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms and will not affect your account.

14. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming.

If you are a consumer resident in a country whose law grants you protections that cannot be waived by agreement, nothing here deprives you of those protections or of the right to bring proceedings in your local courts where that right is mandatory.

15. Changes to these Terms

We may update these Terms. If a change is material we will give reasonable notice on the Service or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not accept them, stop using the Service and close your account.

16. General

  • Severability. If any provision is held unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
  • Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
  • Entire agreement. These Terms, together with the Privacy Policy and the Cancellation & Refund Policy, are the entire agreement between you and us about the Service.
  • Export and sanctions. You may not use the Service if you are located in, or are a national or resident of, a country or region subject to comprehensive US sanctions, or if you appear on a US restricted-party list.
